If you buy something from a store and then realize that it was expired and it made you sick, can you sue?
if you were damaged by it, yes, if not, no...you will never be able to prove that it made you sick and unless you immediately grew three toes on your lip, the court doesn't care.
In the first place, why didnt you check the date first? It is advisable to do so. I always do that when i'm buying food product. I believe you can sue that co for selling products beyond the date.
yes, you could sue.
for example, one of my friend's grandmother got sick from buying an expired food product at a local albertsons.
she had to be hospitalized. while she was hospitalized, my friends mother (the grandmother's daughter) went to albertsons the next day and still found out that they had not cleared the expired food product. so she took pictures.
the grandmother decided to sue, but albertsons gave her a $100,000 settlement.
No because it is your resposibility to look at the expiration date.
Sure, you can always sue, but you will have quite a bit to prove to win. Was the product already expired when you bought it, or did you buy it before the expiration date and consume it afterward? You will have to prove that the store/distributor/manufacturer was negligent in selling you an expired product, which will not be easy. In some states, if you are determined to have been negligent also by not noticing the past expiration date, you will not be able to collect anything. You will also have to prove that you were harmed. If you got a little sick and that's it, you will probably not collect nearly enough to cover your legal fees.
